The Bronx Defenders – an innovative, progressive, holistic indigent defense office in the South Bronx – seeks an experienced attorney with a commitment to social justice to serve as the Associate General Counsel for Legal Practice Matters.


Overview

The Bronx Defenders is a public defender non-profit that is radically transforming how low-income people in the Bronx are represented in the legal system, and, in doing so, is transforming the system itself. Our staff of over 350 includes interdisciplinary teams made up of criminal, civil, immigration, and family defense attorneys, as well as social workers, benefits specialists, legal advocates, parent advocates, investigators, and team administrators, who collaborate to provide holistic advocacy to address the causes and consequences of legal system involvement. Through this integrated team-based structure, we have pioneered a groundbreaking, nationally-recognized model of representation called holistic defense that achieves better outcomes for our clients. 

 Each year, we defend more than 20,000 low-income Bronx residents in criminal, civil, child welfare, and immigration cases, and reach thousands more through our community intake, youth mentoring, and outreach programs. Through impact litigation, policy advocacy, and community organizing, we also push for systemic reform at the local, state, and national levels. We take what we learn from the clients and communities that we serve and launch innovative initiatives designed to bring about real and lasting change.

 New York State is implementing sweeping criminal justice reform this January. These changes will provide meaningful evidence production including the identification of witnesses. These changes will mean that we have a heavier burden to identify and resolve all potential conflicts of interest. In addition, attorneys will have significant reciprocal obligations under the new discovery statute. The Associate General Counsel for Legal Practice Matters will help our litigation practices develop responsible and effective procedures for these new workflows, and provide close support on identifying and resolving conflicts of interest potentially created by the representation of witnesses within and across practices. Working closely with the General Counsel, the Associate General Counsel for Legal Practice Matters will also provide general legal support for our litigation teams on questions of legal professional responsibility and a range of related topics. 

 This is a full-time position, based at our offices on 161st Street in The Bronx. The Associate General Counsel for Legal Practice Matters will report to the General Counsel and will join a team that also includes an Associate General Counsel for Corporate Matters.


Role & Responsibilities

  • Create protocols for conflict checks when e-discovery is produced
  • Advise litigators on identifying and resolving conflicts
  • Advise litigation teams and IT staff on professional responsibility aspects of digital systems for transmitting and storing case materials
  • Establish protocols to ensure that our office is preserving and archiving all e-discovery for appellate and transfer purposes
  • Train lawyers and administrative staff on proper preservation of discovery and other case materials for potential post-trial phases of litigation
  • Train attorneys on reciprocal discovery obligations and consult on all reciprocal discovery questions
  • Assist in the handling of general inquiries regarding other aspects of legal professional responsibility and practice of law

  • Qualifications

  • Admitted to practice law in New York, or readily eligible to practice either upon reciprocal admission or by qualification as in-house counsel
  • Familiarity with New York Rules of Professional Conduct and related areas of law governing topics such as evidence
  • At least five years of relevant experience, including any combination of relevant litigation experience and/or experience with professional responsibility counseling and training
  • Commitment to social justice and defending people in racially and socioeconomically marginalized communities targeted by family, immigration, criminal, and civil legal systems
  • Excellent written and verbal communication skills
  • Strong problem-solving skills
  • Strong organizational and time management skills
  • Ability to work independently on multiple projects simultaneously
  • High levels of motivation and flexibility
  • Ability to work well independently and collaboratively with interdisciplinary teams of attorneys and advocates
  • Ability to effectively and respectfully communicate, collaborate and connect with people from various backgrounds, identities, experiences and positions
  • Ability to think critically and creatively under pressure
  • Ability to receive critical feedback constructively, reflect, and shift behavior accordingly
  • Reliably excellent judgment, discretion, and respect for confidentiality
  •  Salary is commensurate with experience. For candidates with 5-7 years of directly relevant experience, the salary range for this position would be approximately $72,500 - $81,500. Full-time employees are also eligible for a comprehensive benefits package including medical, dental and vision coverage; a 403(b) plan with employer contribution; a generous vacation, sick leave, and parental leave policy. More specific information about salary and benefits will be provided when and if an offer is extended.
